Welcome to MyClubSwap ("we", "us", "our"). By accessing or using our website at myclubswap.co.uk and any related services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our platform.

1. Platform Overview

MyClubSwap is a multi-vendor online marketplace connecting buyers and sellers of second-hand sports equipment. We provide the platform and payment processing but do not own, store, or guarantee the condition of items listed. All transactions are directly between buyers and verified sellers.

2. Account Registration

• You must be at least 18 years old to create a seller account.
• Buyers may browse and purchase without an account, but registration is required for order tracking and returns.
• You are responsible for maintaining the confidentiality of your login details and for all activities under your account.

3. Seller Responsibilities

• Accurately describe items, including brand, size, condition, and any defects.
• Upload clear, original photos of the actual item being sold.
• Enter correct weight for accurate shipping calculations.
• Respond to buyer messages within 48 hours.
• Ship items within the timeframe stated in your listing.

4. Pricing, Fees & Payments

Sellers receive payouts 7 days after the transaction, provided the buyer has confirmed receipt. Funds are transferred to your verified bank account within 3–5 working days.

5. Club Donation Model

Sellers may allocate 25%, 50%, 75%, or 100% of the net proceeds (after fees) to a registered grassroots sports club. Clubs are paid manually once their accumulated balance reaches £50. We verify club details before transfer and never take a commission on donation amounts.

6. Shipping & Delivery

• Shipping costs are weight-based using Royal Mail rates.
• Sellers may offer Local Collection, 2nd Class, 1st Class, or Signed For delivery.
• Risk of loss or damage passes to the buyer upon delivery confirmation.
• Local collection items are collected at the seller's specified location/time.

7. Returns, Refunds & Buyer Protection

As a marketplace for second-hand goods, all sales are final unless:

• The item is significantly not as described (condition, size, authenticity)
• The item never arrives
• The item is damaged in transit

Buyers must open a dispute within 48 hours of delivery. We will mediate and may issue full or partial refunds from the seller's held funds.

8. Prohibited Items

The following are strictly prohibited:

• Items containing personal data (e.g., names/numbers on kits without consent)
• Damaged, unsafe, or recalled equipment
• Illegal or stolen goods

9. Intellectual Property

All content on MyClubSwap, including logos, design, and code, is our intellectual property. Sellers grant us a non-exclusive licence to display their listings. Buyers may not reproduce or resell purchased items for commercial gain without permission.

10. Limitation of Liability

MyClubSwap operates as a technology platform only. We are not liable for:

• Item quality, accuracy of descriptions, or seller conduct
• Shipping delays, loss, or damage by third-party carriers
• Indirect, incidental, or consequential damages

Our total liability shall not exceed the amount of fees we collected from the relevant transaction.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
